Instagram contest rules

ARTICLE 1 - Organizing Company

The company Maison LE MARQUIER, registered with the DAX B Trade and Companies Register under number 303 663 462 and whose registered office is located at 30 Rue Ambroise 1 - 40390 Saint-Martin-de-Seignanx, organizes, throughout the year, free games with no obligation to purchase, on its Instagram account @lemarquier and/or on its Facebook account @lemarquier40

ARTICLE 2 — Conditions of participation

These Contests are open to any natural person of legal age who has an Instagram or Facebook account and who has registered on the @lemarquier / @lemarquier40 web page, excluding members of the Organizing Company's staff, participants in the production of photos, videos and articles, people featured in publications, as well as members of their families (spouses, ascendants, descendants, brothers and sisters). Only entries that comply with all the provisions of these Rules (hereinafter, the "Rules") will be considered.

Participation in the Contest implies unreserved acceptance of the Rules and their principles, without any possibility of complaint with regard to the results. Any fraud, or attempted fraud, manifested by a beginning of execution and committed with a view to improperly collect a prize, non-compliance with the Rules, or any malicious intent to disrupt the progress of the Contest, may result in the disqualification of the author of such fraud or attempted fraud, with the Organizing Company reserving the right to take legal action against said author. Likewise, if it is proven that the progress of the Contest has been disrupted by third parties, but that a Participant is complicit in these actions, his/her participation will also be considered null and void and the Organizing Company may take legal action against said Participant.

ARTICLE 3 — Terms and conditions

Contest with prize draw: participation is exclusively via the Instagram account @lemarquier and/or the Facebook account @lemarquier40. Participation in the contest will only be effective if the following steps have been completed:

The Contest is open on the start and end dates indicated in the contest announcement on the publication or the Instagram story @lemarquier.

ARTICLE 4 — Validity of the Contest with prize draw:

Only one entry per person will be accepted for the duration of the Contest. In the event of multiple entries per person, only the first entry will be considered. In any event, in order to validly participate in the Contest, Participants must strictly comply with the conditions of participation as defined in these Rules, as well as with any other instructions communicated to them by the Organizing Company by any other means.

ARTICLE 5 — Designation of the winner — Allocation of prizes

The Organizing Company will draw lots for each winner (hereinafter referred to as the "Winner") using the website https://commentpicker.com/instagram.php. The draw will be carried out by publishing the link of each publication related to the Contest on the above-mentioned website in order to obtain, by means of an algorithm, the name of the Winner. The Organizing Company reserves the right to verify the winner's correct response to the questionnaire in order to validate the prize.

The Organizing Company will inform each Winner in the linked publication, within a maximum period of two (2) working days after the end of each Contest period. The Winner thus contacted must then, within a period of two (2) working days, confirm acceptance of the prize and provide the postal, telephone and email details to which the Organizing Company may send the necessary documents.

Failure by the Winner to respond within the aforementioned conditions and timeframe shall be deemed equivalent to a pure and simple renunciation of the prize, which may not be claimed at a later date. This prize will then be awarded to another Participant who will have been selected and who will be informed under the same conditions as those set out above. The Organizing Company will proceed in the same way if the email address and/or telephone number used to contact the Winner proves to be incorrect. This process will be used until a winner is found.

For all intents and purposes, it is specified that Participants who are not winners will not be informed.

ARTICLE 5

The Organizing Company cannot be held responsible if, for reasons beyond its control (unforeseeable circumstances or force majeure, or any other event beyond its control which makes it impossible to continue the game under the initial conditions), the Contest is partially or totally modified, postponed or cancelled.

The Organizing Company reserves the right to unilaterally change the prizes, and to substitute them with prizes of the same value in the event of problems with its suppliers.

The Organizing Company cannot be held responsible for delays and/or losses due to postal services and/or their total or partial destruction due to any other unforeseeable circumstances.

The winners authorize LE MARQUIER in advance to include their last name, first name and/or image on its Instagram account, without this use giving rise to any right to remuneration or compensation whatsoever.

ARTICLE 6 — PRIZES

The available prizes are announced in each contest, along with their quantity and value.

The value indicated for the prizes corresponds to the current or estimated retail price, including all taxes, on the date the Rules were drawn up. This value is given as an indication only and may vary.

The available prizes include only what is indicated above, to the exclusion of anything else. For all purposes, it is hereby specified that any personal expenses and/or other costs incurred by the winner in connection with the enjoyment of his/her prize and which are not expressly included in the above-mentioned description of said prize, remain the sole responsibility of the Winner and will not be reimbursed in any form whatsoever by the Organizing Company.

The Organizing Company reserves the right to replace any prize with a prize of equivalent value, particularly in the event of unavailability of the prize initially offered. The prize may not be contested or claimed in any way, nor may it be exchanged, nor may its value be paid in cash at the request of the Winner. In particular, in the event that the Winner is unwilling or unable, for any reason whatsoever, to take possession of or benefit from all or part of the prize won under the conditions described in these Rules, the Winner will be deemed to have waived full entitlement to said prize and may not claim any compensation or consideration from the Organizing Company in this regard.

In the event of a prize being returned due to an incorrect address and/or change of address or any other unforeseeable circumstance (except in the case of an express and justified refusal of the letter or parcel), the prize will be kept available for the Winner for two months. After this time, the prize may be put back into play and no claim will be taken into account.

Please note that this two-month period runs from the closing date of the contest.

Winners must check the condition of the prizes they receive and the contents of packages delivered by the carrier before signing the delivery slip. No claim will be accepted and no prize will be replaced if this check has not been carried out.

In the event of receipt of a defective item, no claim will be accepted beyond a period of 10 days following receipt of the item. In this case, the Winner must make a detailed written claim and return the defective item(s) to the address indicated: The corresponding costs will be reimbursed on the basis of the invoiced rate on presentation of supporting documents.

ARTICLE 7 — VIEWING THE REGULATIONS

These Rules can be viewed by each Participant, for the duration of the Contest, in the contest section of the LE MARQUIER website.

ARTICLE 8 — MODIFICATION

The Organizing Company reserves the right, at any time and without prior notice or obligation to justify its decision, to shorten, extend, postpone or cancel the Contest, as well as to modify all or part of the conditions of access and/or the terms of implementation of the Contest, in the event of force majeure or events beyond its control, without the Organizing Company being held liable or Participants being entitled to any compensation as a result.

In such circumstances, the Organizing Company will endeavor to the best of its ability to inform the Participants as soon as possible. Any Participant will then be deemed to have accepted this modification simply by participating in the Contest as of the effective date of said modification.

ARTICLE 9 — LIABILITY

It is agreed that the Organizing Company may rely, in particular for the purposes of proof of any act, fact or omission, on programs, data, files, recordings, operations and other elements (such as follow-up reports or other statements) of a computerized or electronic nature or format, established, received or stored directly or indirectly by the Organizing Company, in particular in its information systems, in connection with the Contest.

The Participants agree not to challenge the admissibility, validity or evidential value of the aforementioned elements of a computerized or electronic nature or format or media, on the basis of any legal provision whatsoever specifying that certain documents must be in writing or signed by the parties to constitute proof.

Thus, these elements shall constitute proof and, if they are offered as means of proof by the Organizing Company in any litigation or other proceedings, they will be admissible, valid and enforceable between the parties in the same way, under the same conditions and with the same evidentiary force as any document that would be established, received or kept in writing.

The Organizing Company shall not be held liable for any malfunction of the "Internet" network preventing the Contest from running smoothly, in particular due to external malicious acts.

The Organizing Company shall not be held liable in the event that one or more Participants are unable to connect to the Website due to any technical fault or problem related in particular to network congestion.

It is the responsibility of each Participant to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack. The connection of any person to Facebook, Instagram and/or the Website and participation in the Contest is under that person's full responsibility.

The Contest is not managed or sponsored by Instagram/Facebook. Instagram/Facebook cannot be held liable for any disputes arising in connection with the Contest. The personal data collected during the Contest is intended for use by the Organizing Company.

For any questions, comments or complaints regarding the Contest, Participants are invited to contact the Organizing Company and not Instagram/Facebook. All content submitted to the Instagram page announcing the "Contest" event is subject to moderation. The Organizing Company reserves the right to accept, refuse or delete any content, including content which has already been uploaded, at its sole discretion, without having to provide justification for doing so.

ARTICLE 10 — INTELLECTUAL PROPERTY

By participating in the Contest, the Participant declares that he/she holds all intellectual property rights to the elements transmitted to the Organizing Company for the purposes of the Contest.

The Participant further guarantees the Organizing Company that the elements transmitted are original and do not borrow any original element or element protected by any intellectual property right whatsoever.

In this respect, the Participant indemnifies the Organizing Company against any action for infringement of copyright or any action for assertion of copyright relating to the elements transmitted in the context of the Contest.

This authorization is granted without reserve or restriction, for the entire world and for a period of one year from the end of the Contest.

ARTICLE 11 — IMAGE RIGHTS

By participating in the Contest, the Winner(s) authorize(s), free of charge, the Organizing Company to use their last name, first name, image and, where applicable, any other attributes of their personality, for the purposes of any communication relating exclusively to the Contest, by any digital and/or analog process, on any media, worldwide and for a period of one (1) year from the end of the Contest.

ARTICLE 12 — FRENCH DATA PROTECTION ACT — PERSONAL DATA

The personal data collected about each Participant both during participation in the Contest and, where applicable, in order to enable the prize to be awarded, is collected and processed in accordance with the provisions of Law no. 78-17 of January 6, 1978, as amended, on data processing, data files and individual liberties (known as the "French Data Processing Act").

The data collected is for the exclusive use of the Organizing Company. This data may be communicated to service providers and subcontractors that the Organizing Company may call upon for the purposes of organizing and/or managing the Contest.

Insofar as the data collected on each Participant as part of the Contest is essential for the taking into account participation and the delivery of any prizes won, the exercise by a Participant of his/her right to withdraw before the end of the Contest will result in the automatic cancellation of his/her participation in the Contest.

ARTICLE 13 — DISPUTES — APPLICABLE LAW AND JURISDICTION

Should one or more provisions of these Rules be declared invalid and/or unenforceable, the other provisions shall remain in full force and effect. Participants unreservedly acknowledge that the mere fact of participating in the Contest makes them subject to French law, in particular for any dispute that may arise as a result of the Contest or that may be directly or indirectly related to the Contest, without prejudice to any conflict-of-laws rules that may exist. Any dispute arising in connection with the Contest will be settled amicably between the Organizing Company and the Participant. If an agreement cannot be reached, the dispute will be referred to the Superior Court of Paris.

Any dispute or claim relating to the Contest must be made in writing and addressed to the Organizing Company by postal mail and will not be taken into consideration after 30 days. Telephone or written requests concerning the interpretation or application of these Rules, the mechanisms or terms of the Contest or the designation of winners will not be answered.
